The rules of engagement. Please read carefully before starting a project.

These Terms of Service ("Terms") govern your access to and use of the services, websites, and applications offered by W&b Communication ("we," "us," or "our"). By engaging with our agency, you agree to be bound by these Terms.

1. Scope of Services

W&b Communication provides digital agency services including, but not limited to, web development, data analysis, 3D modeling, digital marketing (AdWords), online image management, and hosting/infrastructure solutions. Specific project deliverables, timelines, and scope will be outlined in a separate Statement of Work (SOW) or project proposal.

2. Client Responsibilities

To ensure the timely delivery of projects, the Client agrees to provide all necessary materials, access credentials, and feedback required by our team in a prompt manner. Delays caused by the Client may result in timeline extensions and potential pause fees.

3. Payments and Billing

Payment schedules are detailed in individual project proposals. A non-refundable deposit is typically required before work commences. W&b Communication reserves the right to suspend services, including hosting and infrastructure, if invoices are not paid within the agreed-upon timeframe. All fees are exclusive of applicable taxes unless stated otherwise.

4. Intellectual Property

Upon final payment, the Client receives ownership of the final deliverables created specifically for their project. W&b Communication retains the rights to any underlying code, libraries, and tools developed by our agency prior to the project. We reserve the right to display completed projects in our portfolio and marketing materials unless a Non-Disclosure Agreement (NDA) states otherwise.

5. Hosting and Infrastructure

While we engineer our hosting and infrastructure for maximum uptime (24/7), W&b Communication does not guarantee 100% continuous availability due to necessary maintenance, updates, or events beyond our control (force majeure). We are not liable for business losses resulting from temporary server downtime.

6. Limitation of Liability

Under no circumstances shall W&b Communication be liable for any indirect, incidental, special, or consequential damages, including loss of profits, revenue, data, or digital reputation, arising from the use of our services or failure of our infrastructure.

7. Termination

Either party may terminate a project with written notice if the other party breaches these Terms. Upon termination, the Client is responsible for paying for all work completed up to the date of cancellation.

8. Governing Law

These Terms and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Morocco. Any disputes shall be resolved in the competent courts of Casablanca.
